Human Rights Concept Stands as Accused with COCOY

The Asian Human Rights Commission urges for the charges against Tulawie to be dropped without delay. Unless this wrong is corrected, not only will an innocent individual have to endure a trial of false charges, but the trial itself will effectively undermine the fundamental principles of human rights. It is the fundamental concepts of human rights, and not only Tulawie, that stands accused in this trial.

PHILIPPINES: The concept of human rights stands accused in trial of Sulu activist

Temogen "Cocoy" TulawieThe continued prosecution of human rights activist Temogen "Cocoy" Tulawie, on murder charges based on forced confessions, indicates how human rights are understood in his society of Sulu, and by the public officials ruling it. The case against him questions not only the legality of evidence or the denial of due process, but also reveals a far deeper social and institutional problem unthinkable to many.

The southern island of SULU, where Tulawie lived most of his adult life, was an advanced civilization in pre-colonial Philippines, before torture, extrajudicial killings, rape and massive displacement due to conflict, became a way of life. Sulu had developed trade and diplomatic relations farther than any territories in the archipelago, before the Philippines was even known as a nation-state.
Tragically, what the people in Sulu had achieved in the old days could now only be reminisced in history books, not in the realities of daily life. Sulu has degenerated over the decades due to a deeply entrenched 'gun culture' and 'lawlessness', becoming the complete opposite from its past. In an article Tulawie wrote while in hiding, "Guilty until proven innocent", he grasped the depth of his society's problem: 

"Sulu is possibly the vaguest or most complicated thing one would ever encounter. HR (human rights) workers has to battle against the damaging consequences of governance tailored to suit the vested interests of those in power -- autocracy and anarchy combined. The parasitic nature of both is out there ruining the lives of our common people. The leaders and followers are caught in a corrupted "Lord-and-Slave" mindset where the autocratic Lord sanctions the lawlessness of its followers cultivating a medieval attitude of shamelessness known to any man".
".....In a territory where the value of human lives has become meaningless, it is no surprise that the recording of people’s narratives is perceived to be a meaningless exercise as well. The people's survival is collective and dependent on the strength and influence of those they are attached to. Power struggles and social control is expectedly bloody and deadly. As Tulawie wrote, his society is the "possibly vaguest" and "most complicated" place to do human rights work...."

 The Human Rights Defenders-Pilipinas (HRD-Pilipinas) would like to thank and congratulate your good office for the timely communication and instructions dated 17 January 2012 to Executive Judge Pelacio Paguican of Davao Regional Trial Court regarding Criminal Case Nos (07-09) 1648-3 and (07-09) 1649-3 involving the accused Temogen “Cocoy” Tulawie – a human rights defender (HRD).  We also commend your office through your Executive Judges Pelagio S. Paguican and Peter V. Eisma for the speedy implementation of your instructions.  Such initiatives have arrested the possible further violation of rights of a human rights defender whose intent for filing a motion for transfer of trial jurisdiction is solely for justice and impartiality.
 Our local members informed us that Mr. Tulawie is now in Davao City.  As such, he is under the custody of Col. Michael Dubria of the Regional Intelligence Division (R-2) of the Philippine National Police.
 It is our wish that the wheel of justice will now proceed as expected and the accused be given the right to speedy trialHowever, it reached us that, until today, Tulawie’s case folder has not yet been forwarded to RTC Davao.  This is amid the Supreme Court Order dated 13 June 2011 and repeated requests and follow-ups from the family of the accused to the sala of Judge Betlee-lan Barraquias. 
 We are respectfully asking your good office to put a stop to the defiance of RTC Jolo to your Orders.  Such attitude of the good Judge of Jolo is an action unbecoming of a “man of law” and stains the reputation of the Philippine Courts.

 PHILIPPINES:  ARREST OF A PROMINENT MUSLIM HUMAN RIGHTS DEFENDER FROM   JOLO, SULU
 ISSUES:  FABRICATION OF CHARGES AND ADMINISTRATION OF JUSTICE
URGENT   APPEAL
 Dear Friends,
Human Rights Defenders-Pilipinas (HRD-Pilipinas) was informed by the Task Force Detainees of the Philippines (TFDP), about the updates and information regarding the case of Mr. Temogen Sahipa Tulawie. Several appeals were already sent before regarding the harassment he was facing as a human rights defender.
On January 13,2012 at about 11:45 in the evening, Mr. Tulawie was arrested at his rented house in Davao City by combined elements of Military Intelligence Group (MIG) from Region 9 led by Sgt. Reyes, members of Special Action Force (SAF) led by Supt. Fernando Ortega and members of Police Intelligence (R2).
Mr. Tulawie was already planning to voluntarily give himself and face the charges hurled against him after the Supreme Court already granted the motion he filed for transfer of venue to the Regional Trial Court (RTC) of Davao City, because he believes that he will not be afforded with impartiality if his case will be tried in Jolo, Sulu.
On June 13,2011, the Supreme Court granted the request for transfer of venue. Dispositive portion reads as “ Acting on the Petition for transfer of Venue, filed by Temogen “cocoy” Tulawie, one of the accused in Criminal nos. (07-09) 1648-3 and (07-09) 1649-3 from the Regional Trial Court (RTC) of Jolo, Sulu, to any court as this Court may deem convenient, and considering that there is an indication of actual and imminent threat to the life of the petitioner and his family, as well as his witnesses, as found by the Court of appeals in CA-G.R. SP No. 00002-W/RA-MIN and there is reason to believe that continuing with the trial of the subject criminal cases in the RTC, Jolo, Sulu can lead to a miscarriage of justice”.
Details of his arrest:
Mr. Tulawie was arrested by combined elements of Military Intelligence Group (MIG), Region 9 led by Sgt. Reyes, members of Special Action Force (SAF), led by Supt. Fernando Ortega and members of Police Regional Intelligence Group (R2), of Region 11 based in Davao City, on January 13,2012 at about 11:45 in the evening at his rented house in Elenita Heights Subdivision, Catalunan Grande, Davao City.
They were already sleeping together with his two (2) children, when he was awaken by a loud bang from their door. He turn-on the light at their room, then he awaken his children and told them not to panic.
When the authorities came in, he did not resist arrest. He was taken to Talomo Police station for Police blotter and to Davao Regional Hospital for medical check-up. Afterwards, he was taken to Camp Catitipan, Davao City at the office of the Intelligence division for proper documentation.
As of this writing he was temporarily detained at Davao City Police Office in Camp Domingo Leonor, Davao City. On January 16, he will be presented to the Regional Trial Court (RTC) of Davao City.
Mr. Tulawie was the former Provincial chairperson of Consortium of Bangsamoro Civil Society (CBCS), a coalition of Bangsamoro civil organizations (CSOs) within the province of Sulu. His work involves; monitoring and documentation of human rights violation cases affecting muslim communities in the Autonomous Region of Muslim Mindanao, especially in the province of Sulu.
Mr. Tulawie is facing a case of Multiple Frustrated Murder and Attempted Murder, criminal case no. (07-09) 1648-3 and criminal case no. (07-09) 1649-3 at the Regional Trial Court (RTC) branch 3 of Jolo, Sulu, which was filed on July 22,2009. He was implicated in the bombing incident which was happened in the municipality of Patikul, Sulu on May 13,2009, wounding twelve (12) persons including Governor Abdusakur Tan of the Province of Sulu.
BACKGROUND OF HIS STRUGGLE:
As a human rights defender, Mr. Tulawie has also been active in organizing a local organization named “BAWBUG”, which means “Serve, Respect and Protect” in the Tausug language. Bawbug was established to address the defense of the rights of muslim communities affected by military operations in the province of Sulu.
He was also an active  member of Center for Humanitarian Dialogue (CHD) since 2004-2008 and a council member of Non-Violent Peace Force (NP), in the province of Sulu.
From 2004-2007, he was elected to the post of municipal councilor of the capital town of Jolo, and was one of the organizers of the Concerned citizen’s of Sulu, an organization that works for the democratization of local politics, transparency in governance and upholding of civil rights and liberties of the residents of Sulu.
Mr. Tulawie’s human rights work is long and impressive, but it has also brought him into a collision with powerful local politicians.

Our local ummah is beset by tribulations on issues of bid`ah, please kindly enlighten me about jihad al-akbar (jihadun nafs). Is it bid`ah (innovation) to advocate its significance for change in local society for the benefit of each Muslim (as his/her personal struggle)? We have seen distressing news and images of pervading famine and poverty in Africa, of corruption, oppression, injustice, ignorance (Quran and Sunnah) and some of us Muslims resort to "armed struggle" invoking jihad (fighting). May we appeal to our local ULAMA to balance the disequilibrium of our contemporary milieu by enjoining good and forbidding evil in conformity with the principle of AHLU AL HALLI WA AL AQDI? Some of our local ulama's (May ALLAH bless them, have mercy on them & increase their `ilm (knowledge) & hikmah (wisdom) Ameen) general reply is that politics cannot mix with Islam. I asked: "Is Islam not a comprehensive deen and such political matters can never be dissociated from Islam?"

Thank you for your important question.

The relationship between 'Islam' and politics is not a simple relationship that could be explained in one statement such as either statement mentioned in your question. So, 'Islam cannot mix with politics' is not an accurate statement. Nor is 'political matters cannot be dissociated from Islam' an accurate statement either.

Let us start by defining what we mean by 'Islam' when we talk about politics. In the area of politics, 'Islam' could only mean general guidelines and principles, rather than specific rules and detailed fatwas about specific political matters.

In other words, the part of Islam that deals with the ever-changing area of politics is the part that is about its fixed universal values and principles, and not the part that is about its details and instructions.

For example, when it comes to political participation, the Quranic verses that apply here are the verses that talked about shura (consultation), which is a general and guiding principle. The mechanism of how this consultation should take place is meant, in Islam, to be changeable and to be left for people to define according to their own time and circumstances.

Thus, if the Prophet (peace be upon him) had consulted his companions in a direct and oral way (as narrated about the battles of Badr and Uhud, for example), this does not mean that 'Islam' prefers or encourages some sort of 'direct democracy' over other types of polling systems or political systems.

Any type of democracy, or even a different political theory or system, is approved in Islam only as long as it is compatible with the principles of consultation, justice, equality of human beings, and the other Islamic principles and values.

For another example, the issue of wars (or jihad al-qital) is also a political issue that should only be based on the general guidelines of Islam and cannot have one and only rule for every place and time.

In this area, what is required is to balance two objectives (maqasid): (1) to promote and protect peaceful co-existence, which is one of Islam's higher principles, and (2) to promote and protect Muslims' lives and wellbeing, which is also one of Islam's higher principles.

The default and ideal situation in Islam is peace and peaceful co-existence, and directing the Muslim struggle (jihad) to bettering themselves and improving their morals and spirituality (jihad al-nafs), thus giving a chance for (1) and (2) to be fulfilled together.

This is proven by numerous traditions of the Prophet. One such tradition is 'The Scroll of Madinah' (Sahifat Al-Madinah), in which the Prophet and the Jews of Madinah wrote a 'covenant' that defined the relationship between Muslims and Jews living in Madinah. The scroll stated that, "Muslims and Jews are one nation (ummah), with Muslims having their own religion and Jews having their own religion." (Refer, for example, to: Burhan Zuraiq, Al-Sahifah: Mithaq Al-Rasoul, 1st ed., Damascus: Dar al-Numair 1996, p. 353).

However, if that peaceful co-existence is betrayed by others and Muslims are 'killed and driven out of their homes,' as the other verses say, then fighting is sanctioned in order to protect Muslims' lives.

The problem with many of these militant groups that you mentioned is that they misinterpret the verses of the Quran to mean one choice for all time: war! Every Creature of Almighty God must respect the Sanctity of Life (Hurmat al Hayat), regardless of color, race, creed, belief, origin, or faith.

In reference to the two recently killed US soldiers, US Ambassador Kirstie Kenney said: "They lost their lives serving others and we will always be grateful for their contributions to improve the quality of life [in Sulu]." For her, US troops attached to the Joint Special Operations Task Force-Philippines had not overstayed their usefulness, they were "temporarily deployed at the invitation of the government of the Philippines".

I wearily asked: Subhanallah! How Many Lives Must Be Wasted In Order To Improve the Quality of Life In Sulu?

Same thing for the Eid bombings in Indanan which provoked the pious MNLF mujahideen to defend Islam against aggression, it is rueful that surgical operation was intended by the Government in the name of Peace for Sulu and the Philippines; and the same good intentions of peace and development in Sulu have forged oil exploration in Sulu Sea now, explorers succumbing to the proclivity of satiating their greed for wealth at the expense of irreparable damage to the environment and habitat of all Creatures.

Likewise, for the serialized gang rape, it was inadvertently dismissed by certain officials, and spiritual leader as hearsay to preserve peace in Sulu. In order to repel mafsada, spiritual leaders By Allaahs Will prudently chose not to intervene for and on behalf of Muslimat students in Zamboanga City whose right to hijab is being violated by some hospitals and institutions. These cited cases are proof that Muslims generally love peace and at times will humbly choose to forgive and to suffer dishonor in order to prevent tremendous harm or evil overpowering benefit or good for all.

Amidst these tribulations, what must and can be done bi idhnillaah?
Yaa Allaah let the faithful Muslims arise from stupor and inaction! While we have the strength to decry documented and undocumented violations against the Sanctity of Human Life committed by perpetrators through indiscriminate senseless violence and bloodshed:

Let us unite our voices to say NO, let us shout STOP, and let us do it NOW! When the prevailing situation looks bleak and hopeless, let us always remember:

Yaa Allaah, You are the Supreme Sovereign, inspire our leaders in this world to protect and defend us from all forms of oppression as Khilafaat, as Parens Patriae being Guardians of the State; and if our leaders cannot By Your Will protect and defend us, there still is You, Yaa Allaah ease our difficulties for us as we consistently rely on Your Might to repel evil, allow not foreign armed troops to set foot on our shores if they mean to harm us, if they intend to wreak havoc in our Muslim community for only You has Knowledge of what is Manifest and Hidden;

Everything is indeed threatened of extinction.....the world, environment, culture, arts....
and the endangered species of Muslim Filipinos due to "changing environmental and predation parameters" while others akin to the Philippine Eagle- are bred in captivity :D

Laws must forbid hunting us, must restrict land development and oil exploration in our ""natural habitat". Definitely, creating preserves is out of the list! It will engender a Broken Kris syndrome just as the Broken Arrow to the aboriginal Indians did.



May we be amongst those pardoned, forgiven, and favored by Allah, 
and thus, be granted total understanding of ISLAM,
may Allah grant us beneficial knowledge that we may be more Godfearing;
may we be amongst the unrelenting seekers of knowledge solely for the sake of Allah;
who are in glorious remembrance of Him as our continuous jihad for ilm serves as our Tasbih;
as our consequent imparting of ilm serves as 
sadaqah 
to others;
may we retain our absolute faith and trust in Allah
consoled in our hearts
that the majority can isolate us
for as long as we may never be
amongst the majority isolated from Allah's Mercy....

Sick and tired of being the colloquial PAL (palamunin) member, dole-outs beneficiaries, these Pinoys are unrelenting and are actually rising up to the challenge by not taking flight from windows of opportunities, however, unsecured zones it may seem to be.

These Pinoys are braving the expansive horizon that Almighty God has created for them. They are curious of every square meter area of this Earth, and hope somehow to earn foreign currency and to set foot to a foreign country. It is proactive motivation that propels them to be self-sufficient. After all, there is DIGNITY in honest labor, notwithstanding the threat of unfair labor practices or actually falling prey to it with consent.

Out of the more than 88.6 million population in the Philippines today, are you one among the 27 million (Eiler, IBON, NSO and SWP statistics vary) Filipinos who are either jobless or economically unproductive”? Or do you belong to the “undocumented yet number” of Pinoys who either “work or aspire to work as DH or private tutor abroad” for a measly salary of “250 USD?”

If so, have you been asked why would you want to be an OFW for 250 USD with triple question marks attached at the end of such question? Well, count me in!

After grinning inwardly and rolling my eyes 360 degrees, masha’ALLAH, I typed either you read it wrongly or you never read it at all! Then I texted, “…my article ‘Why Pinoys work abroad for 250 USD’ will be off-press tomorrow. Between you and me thank you for the inspiration, alhamdulillah!”

Personally, I was mildly dejected on how the rice price lately has been hiking up and how the law of supply and demand heavily impacted on the prices of cassava, flour, and pandesal in Sulu. I joked that I will be herbivorous from now on contemplating on the million creative ways of cooking kangkong and malunggay; squash, carrots, and potatoes and other green veggies in Sulu are relatively expensive.

(Quite a challenging prospect for those who are horizontally challenged) Although like any local in Sulu, I love sautéed grated papaya (unripe of course) with shredded unsalted dried fish indigenously known as sayul kapaya and sayul nangka to mean jack fruit veggies cooked in coco milk, again with shredded unsalted dried fish.

Where’s my riposte? That has bearing to my riposte! ;) I am merely acknowledging the looming recession or stagflation coupled with the inevitable law of supply and demand on basic commodities and how this fact inevitably further endangers human security of the endangered poor. That’s for icebreaker.

Well, I am contemplating on working as an OFW but not for 250 USD. However, as I was met with resounding opposition at home and with astounding reaction by my OFW special friend, I turned resolute that I shall work as a Private Tutor despite and inspite of the 250 USD wage which is 150 USD short of the minimum wage set for HSW by the government.

I mentally declared: “For 250$, I want to contribute to the OFW remittance worth 10.7B (Gonzalez, SWP 2007) or a “whopping 12% of GDP” (Altman, 2006)! As a selfless OFW, my remittance can shield recipient households from environmental risks! I want to earn money bi ijnillah through sheer physical and mental effort so I will have the means for my philanthropic propensity.” And… my shred of selfish desire to go on hajj and own a printing press! =D Insha’ALLAH.

Well, I have not been gainfully employed for almost eight years now. I just thought (uhm, psychologists might call this either midlife or personal crisis) what the heck, if I can work voluntarily sans compensation as in gratis for many years now, why wouldn’t I entertain the idea of sweating it out for big bucks? Well, zero centavo as compared to 250 USD, the latter is indeed big bucks, I soon found out.

Yes, I discovered a lot of ignored truths for the jobless and the OFWs. All along, I thought a private tutor is an unequivocal term. I soon found out when I was interviewed by the principal interviewer that it is ambivalent in meaning as in private tutor-cum-household service worker or DH. The employer believes that since the private tutor has nothing to do but sleep from 6 am to 2 pm when the kids are in school then naturally it follows that the private tutor must help with household chores.

Basically, there’s nothing wrong with helping out since I am inherently into volunteerism but there must be absolutely no compulsion. To work as an OFW, and to be an NGO volunteer by choice is entirely different. Indignation seeps into the perspective of legal and social protection along the lines of dignity of labor.

Sadly, foreign employers lack ingenuity. A worker on one’s spare time can do whatever he/she pleases as long as it is not contrary to law. Apart from oversleeping (imagine crossing continents just to oversleep!), one can always read, learn a foreign language at home, browse the web for interactive learning, go to madrasah, paint, exercise, meditate, as well as do personal chores like laundry and ironing.
 
"Whoever works righteousness, whether male or female, while he (or she) is a true believer, verily, to him We will give a good life (in this world) with respect, and We shall pay them certainly a reward in proportion to the best of what they used to do."   Surah An-Nahl:97



My initial reaction was how pathetic it was that most of the jobless Pinoys are compelled to be in concession mode when it comes to agreeing formally to an overseas contract in the presence of a direct hirer due to dire circumstances. The bleak prospect of their status as a degree holder but non-earner, as a local labandera, yaya or katulong for 500 to 1,000 pesos a month fuels their motivation to look for brighter prospect such as 250 USD / 10.25K plus. Why not, indeed?

Confronted with this situation, amidst this background of actual scenarios as I rubbed shoulder to shoulder with fellow jobless citizens, I ultimately understood why they have to and must concede. Although they are victims of human right violations, it is equally an HRV for me to assert for their rights because I have no right to deprive them of their chosen means of livelihood especially that I cannot personally guarantee how they can eke out of living.

It was cathartic in the sense that my dread and indignation- for those undocumented number of exploited, underpaid and abused overseas workers out there and the prospective victims surrounding me- turned into compassion for their plight.

In effect, they have unknowingly but heroically bolstered the GDP growth of the Philippines. May Allah lead us to the peace and security that we are seeking in this world and the hereafter. Ameen.

PS.Unfortunately, I failed in the interview. Miraculously, within 10 minutes, I was rejected as a private tutor because I was a “master” (sic, not mine) but was offered a job in the University by my Kuwaiti interviewer; and to top it all was given 300 USD for my "volunteerism" in Islam efforts. Masha’ALLAH! The amanat given to me was accordingly bestowed.
