The Ulama’s opinion and advice is a crucial elixir on the ills of the Muslim society."


   Aimed at bridging divides among the ulama, asatidz and religious leaders in Sulu, the Al-Mu’tamar al Qimma al-ula lil Ulama fi Sulu: The First Summit of the Sulu Ulama: Bridging Leadership Workshop transpired at Tabang Sulu Center, Capitol Site, Patikul, Sulu last November 4-6, 2006. Various stakeholders who engaged in the dialogue were from the ulama, asatidz, academicians and members of the Jama’ah or muslim congregation. Among them were: Tuan Muktar H. Alan, , Judge Nabdar Malik, Coun Temogen Tulawie, Hji Fazlur Rahman Abdulla, Engr Barjunaid Amilasan, Prof Amirul Ahajul, Prof Ysmail Titing, Tuan Nagdir Abdurahman, Tuan Said Yusah, Tuan Arshaid Abdulmadjid, Dr Hamsali Jawali, Dr Adjili N. Isduri,Tuan Abdurajak Alhari, Ustadz Habier Mohammad and Sulu Grand Mufti Habib Jul-asri Abirin.The Bridging Leadership Framework of AIM-Mirant Center in the context of Islamic principles was adapted by the lead convenors: Dr Hannbal H. Bara and Al-Rashir C. Kulani, in consonance with the indigenous needs of the participants.


Dr Bara and Mr Kulani introduced a variety of concepts and approaches such as Systems Thinking, Causal Loop Diagram, Force Field Analysis and VMOKRAPI.

The convenors impressively steered the participants through a dynamic dialogue to learn and unlearn concepts on leadership, divides, Islamic fiqh, tariqa, da’wah, and madhab. At the end of the day, after co-owning peace and development issues, they reached a consensus on collaborative vision and action plan. The 1st Ulama Summit which was sponsored by the Jolo Municipal Government, Sulu Provincial Government, Pagtabangan BaSulTa and  AIM-Mirant Center marked the launching of Waqaf Foundation, Inc.

The efforts of the organizers must be lauded for three reasons: the inevitable role of the Ulama, the Asatidz, along with the Muslim leaders were re-illuminated through fresher, realistic, meaningful perspectives and insights; the significance and value of  dynamic and rational engagement through dialogue exercise  among religious and other stakeholders was successfully illustrated and applied; and a resolution was drafted and signed resolving conflicting issues on tabligh, salawat between taraweeh, uttered Bismillah against silent bismillah amicably. It affirmed that the tabligh’s practices are not deemed bid’ah (innovation) but is administrative in nature based on a fatwah from Pakistan; that salawat between taraweeh must be encouraged and regulated (solemn and not rowdy) according to the norms of  Islam; and that as to whether Bismillah must be silent or uttered: due respect and tolerance for different madhab must apply.

However, it was disturbing not to see any female participant from the ulama or asatidz sector, although this writer monitored the proceedings of the 3-day summit. The Muslim leaders from Sulu were able to transcend from their individual idiosyncrasies and differences by taking the initiative of seeking points of convergence that will respect as well as tolerate healthy divergence through an interactive Summit. Moreover, an insight need be articulated that the first summit is undeniably a momentous gain that must be nurtured to bear blissful fruits in the future.   “Criminalization” of Human Rights Defenders Condemned

Human rights groups here raised anew an alarm and condemned a global pattern of repression of human rights defenders and as also being experienced in the Philippines.

In a press conference co-sponsored by the Philippine Alliance of Human Rights Advocates (PAHRA), Task Force Detainees of the Philippines (TFDP) and Human Rights Defenders-Pilipinas (HRDP), the said organizations pointed out the widespread campaign especially in developing countries ruled by either civilian and/or military dictators.  One devious pattern is the “criminalization” of persons who defend the poor, vulnerable and marginalized against repressive governance and impoverishing development.  

One of the victims presented by Mr. Max de Mesa, Chairperson of PAHRA, was Mr.  Ales Bialitski from Belarus presently imprisoned since November 24, 2011 in his own country for promoting human rights..  Bialitski is the Vice President of the International Federation for Human Rights (FIDH ) and President of the Belarusian Human Rights Center “Viasna” (Viasna).  PAHRA is the Philippine member of FIDH.

“Any opposition to a repressive regime or authority,” de Mesa said, “will be branded as a crime, including the promotion and defence of human rights.”  “This we experienced during the Marcos dictatorship,” the PAHRA Chairperson continued.  Ales was convicted of alleged tax evasion.

Ms. Rita Melencio, TFDP Deputy for Operations, stated that “the cases of both Mr. Ales Bialitski and Mr. Temogen Tulawie expose the same oftentimes political character of the prosecution and persecution of human rights defenders.”  Tulawie’s advocacies included protecting people in Sulu against abuses during military operations as in the Ipil massacre,  and demanding justice and accountability for moro women victims of rape.  Charges of alleged assassination attempts was filed by Sulu Governor Abdusakur Tan.  Tulawie is presently detained in Davao.

“Also those who defend economic, social and cultural rights,” according to Dr. Nymia Simbulan, Professor of U.P. Manila and Executive Director of PhilRights, “become subject of trumped up charges to silence their active defence of these rights.”  She cited the arrest of leaders and members of indigenous peoples’ communities resisting development aggression in large-scale mining, as well as those urban poor leaders asserting their right to housing against illegal demolitions.

Finally, Dr. Renato Mabunga, Chairperson of Human Rights Defenders – Pilipinas, called on all present to “become human rights defenders and stand for human rights as our common preferred values.” Adding, “after all, this administration has declared adherence to the primacy of human rights.”

There are two fundamental precepts that guide the rights to water in the Shari`ah: shafa, the right of thirst, 
establishes the universal right for humans to quench their thirst and that of their animals; shirb, the right of irrigation, gives all users the right to water their crops. 
Both rules are interpreted in different ways by the various schools of Islam, and their implementation varies from region to region, from village to village, each community applying the law to suit geographical and social circumstances.

A Message From COCOY, Sulu Human Rights Defender

(Translator’s Note: I received this original message by email last Sunday, February 19, 2012. It is originally written in Bahasa Sug by my fellow Tausug colleague, Temogen “Cocoy” S. Tulawie, Sulu-Human Rights Defender. I strive to translate this upon his request. Foremost, I bestow my thankfulness to Allah for not forsaking me, my wife and my children. Allah made a lot of means and instruments- such as help coming from various communities and diverse nations and/or faiths- so that my family and I will not suffer so much difficulty.

Likewise, I extend my thanks to all the organizations who have been helping me all this time: Mindanao People’s Caucus (MPC); Balay Rehabilitation Center; Saligan; Task Force Detainees of the Phil. (TFDP); Consortium of BangsaMoro Civil Society (CBCS); Initiative for International Dialogue (IID); AKBAYAN Party List; Philippine Alliance of Human Rights Advocates (PAHRA); HRD-Pilipinas; Jihad al Akbar and PAHRA-WesMin; United Against Torture Coalition (UATC); Free Debt Coalition; Front Line (Protection of Human Rights Defender); Indonosia Legal Aid Foundation; Asian Human Rights Commission (AHRC) of Hong Kong; Bread for the World of Germany; Non Violence Peace Force (NP);Human Rights Watch International. My beloved citizens of Lupah Sug, I know how much you love and value me; I also know that you desire to aid me; however, there is a reason why you cannot manifest openly your support for me. It has come to my knowledge that many from among you lawyers, doctors, professors along with other CSOs have previously conferred last January 15, 2012. You met to strategize about certain ways and means to help me out from my predicament but unfortunately you were as soon stifled. Patience my brethren, let us exercise restraint; and Allah is witness, I do not wish that anyone from you will incur any mishap all because of me. Only there is one thing that saddens me though: if the professionals or highly educated ones -such as lawyers, doctors, professors and CSO groups- lose the "freedom to speak out" what they wish to express, then, what has befallen our homeland now? I believe that whatever oppression they will inflict upon the citizens of Lupah Sug, there still will sprout two to three people who will rise up in defense of the rights of the people so that our struggle will not end---this is our struggle to be emancipated from the confines of oppressive poverty and our striving to be liberated from the shackles of oppressive fear.

My brethren, do not despair that much if you have been thwarted in manifesting your support for me; even if it be merely in your heart, it is as much valuable and great help. Just recently someone visited me and told me, "Coy, if we are the ones in trouble, you have been able to help us, you fully defend our rights, however, when you were the one who's hit, we cannot even help you. We are reduced to be just a mere onlooker and eavesdropper. Please bear with us, our young brother, we are incapable to buttress the sky." I repeat fervently, there is no cause for you to be anxious because Allah has many ways from various zones so that my well-being will not be neglected. There are many people who are helping me here in Davao to Bukidnon, CDO, Iligan, Marawi, Cotabato, GenSan, Pagadian and even in Manila. Just last Saturday, some human rights org in Manila held a press conference regarding my case. Help are coming my way even from as far as Indonesia, Hongkong and Germany. All these are evidence of the Majestic Power of Allah.

I have not returned to Sulu for two years and 4 months now. I can say that this is the most difficult trial that I have undergone in my lifetime, until I am now detained in this cell for a month and two days now. Notwithstanding, this is the moment when I have contemplated well about my homeland. Inside this cell, we listen to news from the radio often. I often hear Pnoy administration's radio program, "Matuwid na Daan." I told myself the straight path that they are proclaiming here has not reached Sulu.

What transpired during the term of Gloria still persists today; I can even say that poverty has worsened, the foolishness of the "Elders" (elective officials) of Sulu has likewise worsened. Chaos has germinated in the hearts and minds in most of us. This is the consequence of the National government that tolerates our local officials; it even seems that they are in connivance with each other so that we will be trapped within oppression from time to time. Manila government has let our leaders and politicians rob us and indulge in corruption of our land so that we will straggle in poverty.

The poverty that has struck us is no petty matter. It has reached the point that even siblings will not help each other. The other one would think if he shares his own share, by tomorrow he will be left with nothing for himself. We even have lost our traditional values that once even what we are about to feed into our mouth we would rather give to our neighbor who has greater hunger than we have.

My brethren, our kinship ties have been severed by poverty, and so we have lost our solidarity (even in fact unity is demanded by our faith). We no longer have the time to think about our homeland, our thoughts are focused to our stomach.

Likewise, Manila government has not only tolerated corruption by those who govern us, it has also ignored their buying and hoarding of arms in order to sow terror among us; so they can do whatever they want according to their whims- this includes despoiling the daughters of the poor masses such as that of the "Gang Rape case in 2009."

Why did the National Government ignore the foolishness of those who govern us? Perhaps the reason could be that we still shout out our dignity and rights as human beings to the whole world; because we are aware that "our substantive rights as human beings is the door that leads to the freedom of our nation."

I ask you my brethren, do you think that in this kind of predicament that we are embroiled in, and most especially that our siblings in the hinterlands and islands are all in, too: do we have any other option apart from the need to unite? Well, we only have two options to choose from: "to just let it be" or "to unite then to reflect." We must implant in our minds, that if we remain indifferent, the next breed of generation will blame us and we shall be our offsprings' and grandchildren's source of shame. They can never proclaim that their father or their grandfather struggled for the ancestral domain, for the nation, and most of all for our deen from Allaahu Taala. Let us not reason out that we failed to wage a struggle in defense just because we were armless, there is more powerful than arms, we do not need arms, all we need to do is to know and understand our human rights. Absolutely the government is prohibited from degrading us, making us feel that we do not have rights and dignity. My brethren, whatever decadence we can see thriving in our midst at the moment is a consequence of our apathy.

There is truth in the saying, "if a good person remains idle in his own inertness that is the moment that Satan shall reign." My brethren, our homeland has become the laughingstock of all nations in the world.

Lastly, my being incarcerated shall NOT become a reason for me to stop from speaking the truth. Likewise, my imprisonment shall NOT become the reason that I will abandon what I have initiated in the span of 13 years striving to achieve the rights of my own people, my own homeland, and my own nation.

For anyone who does not belong to the People of the Book (Ahlul Kitaab), it will be almost impossible for them to believe that the Holy Qur’an is the ultimate book of all existing books which superseded all divine books before its existence; and that it was a divine product of the author of all authors-God Himself. The Ahlul Kitaab refers to the believers of the Scrolls of Abraham, Torah, Injeel, Zabur or the Book of Psalms, and the Qur’an; the people who believed in Adam, Moses, Abraham, Solomon, David, Joseph, Jesus of Immaculate Mary and Muhammad saw, among other Prophets of Allah. I used limned to mean as a description in words and not written because the Qur’an was technically not written. It was revealed by piecemeal through Archangel Gabriel to the Last Messenger and Seal of all Prophets of God, Nabi Muhammad, s.a.w., sent as Rahmatan lil Aalameen, as A Mercy to the Whole Universe. 

Briefly, the Quran was revealed in Arabic to the Prophet Mohammad in 610 CE over 22 years. In the first twelve years of the revelation, the Prophet was living in Mecca. Persecution then forced him to leave to Al-Madina, in what is known as the Hijra  (immigration), where he lived the last ten years.
The 114 chapters of the Holy Quran are not listed in the chronological order of their revelation. This special order, however, was inspired to the Prophet by Allah, so it is a genuine quality of the Qur'an. Each chapter is described as either Meccan or Madinite, depending on whether the majority of its verses were revealed before or after the Hijra.

The Mother of the Qur’an is the Opening Chapter, the Sura al Fatihah; the Verse of the Throne is the Ayatul Kursi; and the Heart of the Qur’an is the Sura Yaa Sin. The Qur’an, consisting of 114 chapters(Surah) and 6,236 verses &ayat), is an elixir to all physical and spiritual maladies. It guides mankind about marriage, reproduction, sexuality, human rights, wills, inheritance, business and legal transaction, piety, ethics and morality in times of war and peace, as well as science.
 
"He it is Who has sent down to thee the Book: In it are verses basic or fundamental (of established meaning) [Muhkam]; they are the foundation of the Book: others are allegorical [Mutashabeh]. But those in whose hearts is perversity follow the part thereof that is allegorical, seeking discord, and searching for its hidden meanings, but no one knows its hidden meanings except Allah. And those who are firmly grounded in knowledge say: 'We believe in the Book; the whole of it is from our Lord:' and none will grasp the Message except men of understanding." Connected globally at TN, we are proclaiming our respect for the sanctity of Human Life at all times, regardless of color, creed, race or religion; our recognition for the basic rules and principles of the International Humanitarian Law (IHL); and our all out support for International Day of Peace 2009 which bears the battlecry: WE MUST DISARM including the National Month of Peace Consciousness declared by virtue of Proclamation No. 675 bearing the theme Una sa Lahat, Kapayapaan: Putting the Peace Agenda at the Forefront.


Thus, we have instinctively cringed in horror at the appalling news of a horrendous 8-hour airstrike composed of bombs from OV-10 planes and rocket launchers from helicopters committed by the Armed Forces of the Philippines (AFP), particularly the Philippine Marines, in Barangays Kagay, Marang, Bud Timahu, Laum Siang, all part of the municipality of Indanan, Sulu on September 20, 2009, which was the very day of the Muslim celebration of Eidul Fitri. Such offensive is an unspeakable premeditated violation of the Tausug civilians right to life, and which has consequently endangered their right to human security. Moreover, this indiscriminate aerial strike has dismally resulted to the displacements of thousands of vulnerable groups consisting of children, women, and the elderly.

We indignantly invoke the Basic Rules on IHL specifically:
1. Persons hors de combat and those not taking part in hostilities shall be protected and treated humanely.
7. Parties to a conflict shall at all times distinguish between the civilian population and combatants. Attacks shall be directed solely against military objectives.


Our humanity is assaulted and we are disheartened that such incident has happened a day before International Day of Peace 2009 which bears the battlecry: WE MUST DISARM and concomitantly during the last ten days of the National Month of Peace Consciousness declared as such by virtue of Proclamation No. 675. We question: Are we Muslims of Sulu not considered and recognized as Human Lives? Does military surgical operation necessitate the violation of the civilians' Right to Life? We are steadfastly invoking the constitutional provision that Civilian Authority is at all times Supreme over the Military."

In the spirit of peace and solidarity, as we solemnly exercise utmost restraint and sobriety as peaceful Muslims living up to what Allaah has perfected for us amidst this dreadful event, we invoke on Almighty ALLAH as Al Malikul Mulk that Her Excellency President Gloria Macapagal Arroyo in her capacity as Commander in Chief of the AFPheed our plaintive appeal and lamentation over this violation of Human Life and Security on the very day of Eidul Fitri; and that we may see the spirit of the Filipino Nations aspiration of Una sa Lahat, Kapayapaan: Putting the Peace Agenda at the Forefront.

    Islam gave to mankind an ideal code of human rights fourteen centuries ago. These rights aim at conferring honour and dignity on mankind and eliminating exploitation, oppression and injustice.
Human rights in Islam are firmly rooted in the belief that God, and God alone, is the Law Giver and the Source of all human rights. Due to their Divine origin, no ruler, government, assembly or authority can curtail or violate in any way the human rights conferred by God, nor can they be surrendered.
 
    Human rights in Islam are an integral part of the overall Islamic order and it is obligatory on all Muslim governments and organs of society to implement them in letter and in spirit within the framework of that order.
 
     It is unfortunate that human rights are being trampled upon with impunity in many countries of the world, including some Muslim countries. Such violations are a matter of serious concern and are arousing the conscience of more and more people throughout the world.
 
     I sincerely hope that this Declaration of Human Rights will give a powerful impetus to the Muslim peoples to stand firm and defend resolutely and courageously the rights conferred on them by God.
 
    This Declaration of Human Rights is the second fundamental document proclaimed by the Islamic Council to mark the beginning of the 15th Century of the Islamic era, the first being the Universal Islamic Declaration announced at the International Conference on The Prophet Muhammad (peace and blessings be upon him) and his Message, held in London from 12 to 15 April 1980.
 
    The Universal Islamic Declaration of Human Rights is based on the Qur'an and the Sunnah and has been compiled by eminent Muslim scholars, jurists and representatives of Islamic movements and thought. May God reward them all for their efforts and guide us along the right path.

I reiterate my stand :
With all due respect: The urgency of a separate and exclusive creation and establishment of HRO and HRC in ARMM including other parts of the Philippines, merely exposes the irony that the "HR in its universal concept and principle is generally NOT intrinsic in practice in our political/governmental system.

HR should have been integral and inclusive to EVERY legal department/division in ARMM and throughout the archipelago to fulfill, respect and promote the dignity of every Filipino regardless of faith. Right there and then, redress for HRV could have been served.

Thus, creating a semblance of equilibrium between  "respecting (rights of others)" vis a vis "asserting (one's own rights)." This must be paralleled by integrated HR approach in teaching.

A sin that leads to Jannah!

 

Imaam Ibn al-Qayyim – may Allaah have mercy upon him – said in his famous book al-Waabil as-Sayyib min Kalaam at-Tayyib
…So if Allaah intends goodness for His slave [after he has fallen into a sin], He opens up the doors of repentance for him and puts [in his heart] the feeling of need [for Allaah] and makes him dependant upon Allaah. Allaah grants him humbleness and brings him closer to Himself through enabling him to preform good deeds, and this one sin was the reason behind a [mountain] of good deeds, so much so that the enemy of Allaah [Iblees] will say, o how I wish I had never made him commit that one sin!
This is the meaning of some of the salafs saying:
Verily a slave commits a sin, and thereby enters Jannah [because of it] and he preforms a good deed and enters Hell because of it.
They said and how is this?
And it was said, [this is because] he commits the sin and he does not cease shedding tears concerning it, fearing [its consequence] regretting it, feeling shameful before his Lord the Most High. Hanging his head low with a broken heart, because of this, the sin is in truth more beneficial for him as it is the source of many good deeds after it. And through it the slave attains salvation and success, so much so that this sin becomes the reason for the slave to enter jannah [i.e through the mercy of Allaah].
And he [might] preform a good deed and does not cease in mentioning that, and feeling full of pride and is amazed at himself saying I did and I did! [i.e boasting] so pride enters [his heart] which results in his destruction

What a shame! Man has a lot to learn from Nature, in terms of absolute surrender to Allah's Will. 
It is utter folly to squander the Gift of Choice: 
To Earn Allah's Love :)

Residents scamper to safety after a 6.8 earthquake hit near Cebu City on Monday.
A 6.8-magnitude earthquake that struck Monday off the third-largest island in the Philippines has killed at least 15 people, the government said.
Another 29 people were missing after a landslide in the city of Guihulngan, it said.
The quake struck at 11:49 a.m. about 70 kilometers (44 miles) from the coastal city of Dumaguete on the Philippine island of Negros, the U.S. Geological Survey said.
The dead included two elementary school children, authorities said, according to the Philippines News Agency. The girls died when walls at their schools collapsed on them, National Police spokesman Chief Supt. Agrimero Cruz Jr. said.





Surah AL-Zilzal
Section 1 [99:1-8]

 When the earth is shaken with its appointed tremor.
 And the earth throws out its burdens.
  And man says, “What has happened to it?” 
 On that day earth will narrate its news,
 Because your Lord sent a command to it.
 On that day men will return towards their Lord, in different   groups, in order to be shown their deeds.
 So whoever does a good deed equal to the weight of the  minutest particle, will see it. 
 And whoever does an evil deed equal to the weight of the minutest particle, will see it.

“  There are five kinds of martyrs:    1. One who dies of plague; 2. one who dies of a disease of the stomach or intestines; 3. one who drowns; 4. one who is crushed in a collapsing building; and 5. one who is martyred in the way of Allah.” [al-Bukhari]

Ya Rabb, we are humbled that when disaster fall upon us indiscriminately, You send your punishment only to the wrongdoers but you send MERCY to the faithful believers....alhamdulillaahi Rabbil aalameen!

Shaykh Ibn Baaz (may Allaah have mercy on him) said:
What must be done at the time of an earthquake or other calamity, or an eclipse, strong wind or flood is to repent to Allaah, may He be glorified, and to beseech Him and ask Him for well-being, and to remember Him a great deal and ask Him for forgiveness, as the Prophet (blessings and peace of Allaah be upon him) said at the time of an eclipse:
When you see that, then turn to remembrance of Allaah and call upon Him and ask for His forgiveness.
Agreed upon. It is also mustahabb to show compassion to the poor and needy, and to give charity to them, because the Prophet (blessings and peace of Allaah be upon him) said:
“Show mercy, you will be shown mercy.” (Narrated by Ahmad) And he said: Those who show mercy will be shown mercy by the Most Merciful. Show mercy to those who are on earth and the One Who is in heaven will show mercy to you. Narrated by al-Tirmidhi
And he (blessings and peace of Allaah be upon him) said: “The one who does not show mercy will not be shown mercy.” Narrated by al-Bukhaari. It was related from ‘Umar ibn ‘Abd al-‘Azeez (may Allaah have mercy on him) that he used to write to his emirs when earthquakes took place telling them to give charity.
